All sales made by Varabella LLC ("Seller") to you ("Customer") are governed by these Terms and Conditions of Sale unless otherwise indicated by Varabella LLC in writing.

PLEASE READ THESE TERMS AND CONDITIONS THOROUGHLY BEFORE PLACING AN ORDER. DO NOT PLACE AN ORDER UNLESS YOU UNDERSTAND THESE TERMS AND CONDITIONS AND AGREE TO ABIDE BY THEM. VARABELLA LLC RESERVES THE RIGHT TO AMEND OR MODIFY THESE TERMS AND CONDITIONS OF SALE AT ANY TIME AT ITS SOLE DISCRETION.

Products, Content, and Specifications.

All features, content, specifications, products, prices, and services described or depicted on this Web Site are subject to change at any time without notice. All weights, measures, and similar descriptions are approximate and are provided for convenience purposes only. We make all reasonable efforts to accurately display the attributes of our products, including the applicable colors however, the actual color you see will depend on your computer system and we cannot guarantee that your computer will accurately display such colors. The inclusion of any products or services in this Web Site at a particular time does not imply or warrant that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any item purchased from this Web Site. By placing an order, you represent that the products ordered will be used only in a lawful manner.

Typographical Errors.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge.

Sale is Contingent on Customer's Acceptance of Terms and Conditions.

Seller shall not accept Customer's purchase orders unless and until Customer consents to these Terms and Conditions of Sale. These Terms and Conditions of Sale (as set forth on this website) supersede the terms and conditions of Customer's purchase order(s) and will govern all transactions between Customer and Seller. These Terms and Conditions of Sale also apply to all future transactions unless modified in writing signed by Seller and Customer.

Payment Terms.

Seller ships orders COD for the remainder of balance for larger orders exceeding $5,000.00, or accepts cash / cashier's check, Visa / MasterCard, Discover or American Express. Customer will be charged a $25 service charge for any returned check. Custom orders require different payment terms, as specified below. Pre-paid orders will be charged in full upon first shipment, even if multiple shipments may occur. Credit card orders in excess of $7,500 may be subject to an administrative surcharge. COD orders in excess of $250 require payment by certified funds.

Sales Taxes Retail only.

We shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

Shipping.

Buyer is responsible for all shipping and freight charges. Inventory will fluctuate on seasonal items. Orders are normally shipped by UPS or Federal Express. Seller will ship using a carrier designated by Customer upon request. Seller will not be responsible for shipping delays caused by a carrier. Shipping charges may be billed separately on credit card orders.

Specials and Promotions.

Special offers, coupons, or discounts cannot be used in conjunction with other offers. Limit one promotion per order. Please read the official rules that accompany each special offer, coupon and discount.

Notice of Defects.

Customer is responsible for inspecting the merchandise upon receipt. Customer shall notify Seller in writing WITHIN 3 DAYS OF CUSTOMER'S RECEIPT OF THE MERCHANDISE of any claims for damages resulting from late delivery or any defect in the merchandise discovered by Customer, including, without limitation, claims related to shortages, quality, or specification. UNDER NO CIRCUMSTANCES WILL SELLER ACCEPT CLAIMS OR RETURNS OF MERCHANDISE WHICH HAS BEEN ALTERED OR MODIFIED IN ANY MANNER.

Returns and Cancellations.

Returns.
Retail customers: If you wish to return your purchase, please follow these steps:

1. Contact us at 1-800-705-5991 or send an email to Amy@varabella.com

2. Return the item(s) to us within 7 days with the original packaging and in a re-saleable condition.

3. Send the parcel to us at the following address:

Please note that you are responsible for any returned goods until they reach us. We strongly advise you to obtain insurance for the value of the goods, to give you protection should the parcel get damaged or lost. Once we receive the goods, we will check them and process as soon as possible for return or exchange.

Wholesale customers: Authorized returns and exchanges must be made within 7 days after Customer's receipt of merchandise. All returns and exchanges will be subject to a 15% restocking fee in addition to freight and COD charges. Seller's written authorization must accompany all returned merchandise. No order can be canceled once it has been entered into production. Customer will be responsible for all freight and shipping charges on items returned that are not the result of Seller's error. Obtaining Return Authorization: In each shipment a "Return Form" is provided for Customer's convenience. For returns less than $1,000.00 total, Customer may call Seller's customer service department at 1-800-705-5991 to obtain the RMA Number (Return Material Authorization Number) to validate this form. For returns in excess of $1,000.00 total, Customer must fax a written request for the RMA Number to Seller at 1-800-360-5113 (Attn: Customer Service), stating the reason for the return or problem with the merchandise. Once received, Customer may simply enter it in the appropriate field on the form, include it in your shipment and send your return to us

Customer will receive a credit posted to their account for any such return once it is received and checked in by Seller's warehouse.

Customer Acceptance of Late or Defective Merchandise.

Customer's failure to provide written notice of a claim, as set forth in these Terms and Conditions of Sale, shall constitute a waiver of any claim Customer may have for damages resulting from such defects, including late delivery.

Prices, Quantities, Styles, Colors.

Prices are subject to change without notice. All merchandise will be shipped at the prices in effect at the time of shipping. Varabella LLC reserves the right, at its sole discretion, to change or discontinue styles, colors, sizes or fabrics. All orders are subject to availability.

LIMITATION ON LIABILITY.

CUSTOMER ACKNOWLEDGES THAT SELLER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR OTHER INTANGIBLE LOSSES (EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), OR PERSONAL INJURIES OR DEATH RESULTING FROM USE OR SALE OF THE SELLER'S MERCHANDISE.

No Liability for Outside Vendors.

Seller shall not be liable for any work performed by any third party vendor referred by Seller and hereby waives any right to assert any claim against Seller for work performed by any other third party or vendor, including but not limited to claims for negligent referral, agency, or respondent superior.
Our limited warranty covers against defects in material or workmanship one year from the date of purchase. A valid sales receipt must be included to show your product was purchased within the warranty period.

Warranty & return,

 

A one year limited warranty applies to the top and the bottom attaching zippers only. Varabella must be notified within 90 days upon receipt to the customer for Varabella to pay for shipping. Varabella will send out a call tag for UPS when a warranty return is authorized. Consultant must confirm with Varabella about the issue of a call tag for their customer. After the 90 days the customer will pay all shipping cost back to the company.

 

For any reason a customer is dissatisfied with their product there will be 7 day exchange period for a replacement bag or choice of another bag of equal or lesser value.

 

Any manufacturer defects made during the making of the product, consultants or retail customers must call Varabella within 14 days upon receipt of the product. Varabella will send out a call tag for repair or product exchange after being authorized.

  • A note which includes your name and return address, phone number and email address. Also within that note detail the problem you are having with your product.
  • A copy of your sales receipt.
  • Check or money order made payable to Varabella LLC for the appropriate service charge, or you can send us your credit card information, which includes your credit card number and expiration date.

These Terms and Conditions of Sale constitute the entire agreement between Seller and Customer, superseding any prior agreements between Customer and Seller. The failure of Seller to exercise or enforce any right or provision of these Terms and Conditions of Sale shall not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms and Conditions of Sale must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in these Terms and Conditions of Sale are for convenience only and have no legal or contractual effect.

Revisions to the Terms and Conditions.

We may revise these Terms and Conditions at any time and from time to time by updating this posting. You should visit this page from time to time to review the current terms and conditions because they are binging on you. Certain provisions of these Terms and Conditions may be superseded by expressly designated legal notices or terms located on particular pages at this website.
